Top Kendall Prosecutor Heads to Private Practice with Ekl, Williams & Provenzale

Kendall County First Assistant State’s Attorney Nemura “Mu” Pencyla has recently become associated with the leading DuPage law firm Ekl, Williams & Provenzale, after serving the public for the last 23 years, according to one of its founding partners, Terry A. Ekl.


Nemura had been appointed First Assistant by Eric C. Weis in 2010, and prosecuted the most serious and complex cases in that office, including financial and public integrity crimes, homicides, and physical and sexual child abuse.  He also coordinated and conducted extensive Grand Jury investigations into sophisticated financial and public integrity offenses.


Nemura had previously served as an assistant state’s attorney in three counties over his career as a public servant; he was also appointed to serve as an Independent Special ASA in several other neighboring counties. He was originally hired by Jim Ryan to serve in the DuPage County State’s Attorney’s Office.  During his 6 years at that office, he was an integral member of both the Special Prosecutions/Financial Crimes and the Domestic Violence Units.


Nemura then joined the Kane County State’s Attorney’s Office.  Pencyla concluded his term at that office as a member of the Priority Prosecution Unit, which prosecuted violent and high-profile crimes. Pencyla also headed that office’s Narcotics Unit, and was assigned to the Child Advocacy Center.


As a prosecutor, Nemura has had many successes.  He was probably most heralded for his tireless work behind the scenes on the “Operation First Degree Burn” cold case indictments of 2007. This investigation and prosecution focused on 32 cold-case homicides by 22 defendants, requiring intense inter-agency cooperation on federal, state and local levels.  For his work on the project, Pencyla was named Kane County’s Prosecutor of the Year for 2007 and was recognized by the Chicago Crime Commission for his work, receiving the “Star of Distinction.”


Recently, he represented Grundy County in a civil lawsuit, resulting in a substantial settlement that benefitted the County by securing the recovery of illegally paid per-diem vouchers by a county board member.  He was also instrumental in conducting multiple investigations into complex financial crimes that resulted in either the recovery of substantial monies owed to local businesses, housing agencies and other governmental agencies, or to the cessation of illegal conduct.


Nemura has earned a well-deserved reputation for his zealous defense of crime victims, his compassion for child victims and his versatility. In addition, he always has shown great passion for his job and the rule of law.  Nemura will now be taking that reputation and passion for the law to Ekl, Williams & Provenzale, where he will concentrate on civil rights and contested civil litigation.


Nemura, 48, is a graduate of Benet Academy in Lisle, a 1991 graduate of Carleton College in Northfield, Minnesota, and a 1994 graduate of the Washington University School of Law in St. Louis, Missouri.
