Intellectual Property MCLE

Topic: Demonstrating use of Trademarks to the USPTO

A client may be rolling out the use of a trademark or service mark, but may not be “using” the mark in a way that the US Patent and Trademark Office (USPTO) will accept as supporting a registration.  We will discuss what the USPTO regards as “use” of a trademark and service mark, what qualifies as “use in commerce”, and how to demonstrate both to the USPTO.

Speaker: Jeff Perkins of Perkins IP Law Group LLC

Jefferson Perkins is the principal of Perkins IP Law Group LLC.  He has practiced intellectual property law for 31 years, and has officed in DuPage County for the last eleven.  Prior to this time Mr. Perkins practiced in Chicago or Dallas as a partner in each of several large general civil practice firms.  His practice extends to all phases of acquiring, defending, asserting and licensing patents, trademarks, copyrights and trade secrets, both domestically and internationally.  Mr. Perkins received BSEE and BS LAS degrees from the University of Illinois at Urbana-Champaign in 1978 and a JD (Distinction) from the John Marshall Law School in 1983.  He is a registered patent attorney.
