An Overview of Special Education Law



Children’s challenges can be a result of undiagnosed disabilities and trauma, among other causes, and will appear across environments in school, at home and in social circumstances. Under federal and state law, Districts are required to identify and evaluate children in all areas of suspected disability. Children may be eligible for an Independent Educational Program or a 504 Plan in school. They can be provided with academic, social-emotional, functional and therapeutic supports among others, in the school setting. As you advocate for children, you should minimally be aware that school can be a struggle for many children for different reasons and the District can be requested to perform an evaluation to determine what a child needs to make progress in school.

   1. A brief overview of the Individuals with Disabilities Act and Section 504 of the Rehabilitation Act and how they relate to special education. 

   2. What the process looks like to request an IEP or 504 Plan.

   3. How remote learning has impacted special education.
