Title: A Lawyer's Guide to Responding to a Data Breach.

Summary of Topic:  In this session, you will hear from two experienced practitioners in the data security and privacy space who will provide insight into how to respond when a client – or even your own firm – learns about an unauthorized party accessing sensitive information.  They will provide an overview of the legal landscape, including discussing the applicable data breach notification laws at the state and federal level.  Then, they will review the top immediate steps when initiating an investigation, and will share best practices and lessons learned from real life incidents.  They will also discuss the ethical obligations lawyers have in dealing with data security.

 

Learning Objectives:

1.) Learn what to do when faced with a data security incident.

2.) Learn about best practices to minimize risk and exposure in a data security incident.

3.) Learn about the data breach notification obligations under various state and federal laws.

4.) Learn what your ethical obligations are as an attorney in connection with data security within the firm and when dealing with clients.

 

As a reminder, only DCBA members will receive MCLE credit for this presentation.
