Presentation Title: Environmental Due Diligence: What Every Attorney Should Know

    

Summary of presentation: The presentation will refresh the basics of environmental due diligence, covering why it is important, what is required and what to look for in Phase I Environmental Site Assessments. Eric will discuss the many problems that face attorneys and their clients that arise from environmental due diligence. Poorly written reports and short cuts may leave clients exposed to liability or unnecessary costs from further investigation. Eric will review case studies that will show the true cost of these errors and how to avoid these costly mistakes. Eric will also discuss alternative options such as insurance and environmental risk transfer to provide protection in lieu of full-scale investigations and cleanups.  

 

Learning Objectives:

1.) The attendees will gain an understanding of environmental due diligence and the requirements under CERCLA for liability protections.

2.) The attendees will learn about what is required in due diligence reports and how to spot deficiencies.  

3.) The attendees will gain an understanding of the risks, liabilities and costs due to improper environmental due diligence. 

4.) The attendees will gain an understanding of what to do after the Phase I Environmental Site Assessment is complete and understand what cost-saving alternatives maybe present.
