Speaker: Betty Tsamis of Tsamis Law Firm


Topic: Most practitioners who deal with employment law issues have a general understanding of the FMLA and ADA. As the workplace become more complex, so do the unique issues that arise under the FMLA & ADA. Betty will discuss  some of the emerging issues: How are employers with fewer than 50 employees estopped from defending on the basis of the 50/75 rule? Can an employer terminate an employee before the exhaustion of FMLA without violating the FMLA? Is the ADA still good for medical leaves of absence?

 


What you will learn from attending this presentation:

1. There will be a discussion regarding how estoppel can work to shut down an employer's defense that it is not a "covered employer" or that an employee is not an "eligible employee".

2. There will be a discussion regarding how to determine when the ADA can be used for protected leave.   

3. There will be a discussion regarding when an employer can terminate an employee while the employee is on FMLA.
