Considerations for the Intersection of Divorce and Bankruptcy


Summary: This presentation will use the recent case of Reinbold v. Thorpe (In re Thorpe), 881 F.3d 536, as a springboard for a discussion about some of the common issues that arise when a bankruptcy case and a divorce case are simultaneously pending. Specifically, focusing on competing interests in marital property. This discussion will take a practical look at these issues and the considerations when this situation arises.

  1. Special considerations when divorce and bankruptcy cases are simultaneously pending.
  2. How the courts can/should view the competing property interests.
  3. What the recent case law developments in this area are.
