Summary: Immigrants living in the US may hold one of several statuses: they may be US citizens, permanent residents, temporary residents, or without legal status (the undocumented). As a result, many families in Illinois domestic relations courts are “mixed status.” This presentation will provide a check list for attorneys who are unfamiliar with the ramifications of their client’s immigration status on domestic relations issues such as allocation of responsibility and ascertaining income for support obligations. Finally, it will look at how domestic relations law affects their client’s immigration status, particularly the effect of divorce on marriage based petitions.


Learning Objectives:

1) How to identify the different immigration statuses which are possible: permanent, temporary, or undocumented;

2) How immigration status affects custody issues;

3) Practical as well as theoretical considerations regarding child support and maintenance awards;

4) How immigration law impacts the domestic relations client especially in terms of the affidavit of support and the impact of divorce on a marriage based petition.
