Family Law MCLE Meeting


"Post-Judgment Compliance: Going Beyond Indirect Civil Contempt"

Time: 11:45pm to 1:00pm - this meeting will start promptly at 11:45 with Case Law Updates presented by Leah Setzen

The focus of this presentation will be on violations of parenting agreements (e.g. decision-making) and other specific provisions of orders that may not have a classic "key to the jail cell" answer vis a vis an indirect civil contempt petition.  The focus will not be on child support/maintenance.

Brigid Duffield will speak on the mediation perspective, Chuck Roberts will speak on the litigation perspective, and the Judges will weigh in on their perspective from the bench.

Brigid will present ideas on how to address the kinds of issues amicably when they arise in the first place, or avoiding litigation.  She will also give tips on language to use in orders and parenting agreement sto make it easier to enforce down the line.

Chuck will speak on litigation matters, with a discussion of some petitions or approaches to handling these violations when they arise.  He will provide some sample petitions or statutory sections lawyers can refer to.

The Judges will give their impression on the whole concept of non-civil contempt post judgment compliance.  They will offer the attorneys what they would prefer to see when the violations arise, what not to do, how to punish someone and ensure compliance with orders/agreements going forward, etc.  Questions will be taken from the audience.
