Estate Planning & Probate/Elder Law Joint MCLE Meeting

Speaker: Linda Strohschein, Strohschein Law Group, LLC & Elder Law Vice Chair

Topic: The ABC's on Long Term Care Issues: 26 Tips for Real Life

Summary: As Estate Planning attorneys and Financial Planners, we are well versed in Wills, Trusts, Powers of Attorney and many other kinds of planning documents.  Bud do yo know what to do when your parents need nursing home care?  Perhaps you are not aware of the need to ask about inpatient or outpatient status at the hospital, which may cause your loved ones to incur a higher-than-necessary hospital bill and forego much needed rehabilitation.  When placement is necessary, do you know the differences between all of those "senior residences" in their community? Knowing a little bit about long term care issues, such as Medicare and Medicaid, Long Term Insurance and facility contracts, can be helpful to spot critical issues for both your clients and your family members.

Learning Objectives

1.  Become familiar with Medicaid, the appeals process, gifting for Medicaid, how to plan ahead for a Medicaid penalty and how you can help your clients looking at Medicaid protect assets within the law.

2.  Learn about the different types of Long Term Care facilities, their costs and ways to pay for the care.  Identify points to ensure that your client's attorney is looking for when reviewing a nursing home contract.

3.  Provide an overview of the basic legal documents that may help protect your  clients as they move into a Long Term Care facility.

4.  Learn how the Jimmo v Sebelius case could have a financial impact on your clients
