Illinois Supreme Court--Standardized Forms Update

The Illinois Supreme Court's Commission on Access to Justice is pleased to announce new updates to the statewide standardized court forms.
According to recent revisions made to Illinois Supreme Court Rule 12(b), effective today, service can be proved by a 735 ILCS 5/1-109 certification even if the person is not an attorney. Previously SCR 12(b) required non-attorneys to prove service by affidavit. Therefore, the notary section has been removed from the following forms that contained a notary section for purposes of proving service:

•         Proof of Delivery form suite
•         Answer/Response form suite
•         Appellate Proof of Service form suite
•         Mortgage Foreclosure Answer/Appearance form suite
•         Mortgage Foreclosure Motion to Stay form suite
•         Mortgage Foreclosure Motion to Stay Notice form suite
•         Mortgage Foreclosure Motion to Vacate form suite
•         Mortgage Foreclosure Motion to Vacate Notice form suite
•         Motion form suite
•         Notice of Motion form suite

Additionally, updates have been made to the Adult Name Change forms based on comments submitted by the public. The changes include modifications to the How to Change your Name (for an Adult) instructions and to the Publication Notice of Court Date for Request for Name Change.
