Recently, Anglican Priest Father Marcos Cardenas spoke with attorney Matthew Katz at Katz Law Office, Ltd. on his radio show, The People’s Right (“El Derecho Del Pueblo”), regarding recent events on Iguala, Guerrero and the wider issue of political and refugee asylum from a legal standpoint. More than 40 students on their way to protest the government in Iguala, a small town in the state of Guerrero in Mexico, were kidnapped in September 2014 and have not been seen since that time. Their families now face the fear of retaliation from the officials who took the protestors and may be seeking asylum.

"Those who have power are not sensitive to people's needs. The uprisings are the result of poverty and hunger and the authorities' mismanagement. People rise up when they do not have what they need, and so it is the responsibility of the government to respond appropriately rather than detain those they do not agree with," Cardenas said.

Attorney Katz and Father Cardenas discussed the wider issue of government power and the rights of the citizens who had been targeted. If their families feel they are in danger, they may seek asylum assistance with the help of an experienced immigration lawyer.

Asylum is typically granted in relation to political strife in foreign countries, but the issue has garnered attention in the legal community as well due to the number of domestic violence occurrences abroad. The debate over whether women who had been victims of domestic violence abroad can apply for political asylum once they arrive in the United States has occurred for many years. Previously, the law deniedwomen who had been victims of domestic violence to seek asylum or safety out of their home country and away from their abuser. These women were not considered part of a "social group," a key factor in determining asylum.

Today, the laws have been widened to include domestic violence victims as well. According to the summary of the decision of the Board of Immigration Appeals, "domestic violence often involves harm that may be serious enough to be considered persecutory." Thus, victims of domestic violence from foreign countries may now seek asylum when domestic violence takes place abroad.
