Topic: HIPPA/HITECH - A Brief Overview and Update on the Final Rule


Presentation will cover an overview of the HIPAA and HITECH Rules, including discussion on the recent Omnibus (Final) Rule that modified various aspects of the HIPAA, such as breach reporting requirements for Covered Entities and Business Associates, restrictions and/or prohibitions on the marketing and/or sale of protected health information, increased penalties for HIPAA violations, HIPAA audits, and the development of mandatory accounting disclosures of protected health information per entity.


Jennifer Stuart is a partner in the Chicago office of SmithAmundsen and a member of the Health Care Practice Group. She concentrates her practice in healthcare compliance and the defense of medical malpractice, hospital liability, and other complex litigation claims at the trial and appellate levels. Ms. Stuart regularly consults with clients regarding healthcare compliance issues, patient privacy concerns and HIPAA compliance, credentialing issues, NPDB reporting, MMSEA legislation and reporting requirements, and the applicability of the Illinois Medical Studies Act.

Colin Gainer is an associate in SmithAmundsen’s Chicago office and a member of the firm’s Health Care Practice Group, where he practices medical malpractice litigation and healthcare regulatory compliance consulting. Mr. Gainer has significant experience dealing with issues related to health information technology. He has provided consultation services on HIPAA and HITECH compliance for covered entities and business associates, data breaches and HIPAA audits. Mr. Gainer is certified in Healthcare Privacy Compliance (CHPC) designation from the Compliance Certification Board, demonstrating knowledge of privacy compliance procedures and the ability to implement policies and programs to ensure healthcare providers and business associates observe federal, state and local healthcare privacy regulations
.
