The Enforcement Challenges for Tattoo Copyrights

Audience Skill Level: Intermediate

Brief Summary of Topic: Professor King will be presenting "The Enforcement Challenges for Tattoo Copyrights."  This presentation is an overview of an article that is part two of a three-part series on the applicability of copyright law to tattoos.  This presentation explores whether the owner of a tattoo copyright should expect less protection than the copyright owner of a work fixed in a traditional medium.  Professor King concludes that an artist’s choice of the human body as the medium of expression raises legal and practical concerns that necessitate a diminution in the exclusive rights of the copyright owner vis-a-vis the bearer of the tattoo.  With respect to third parties, however, Professor King concludes that vigorous enforcement of the tattoo artists’ rights is warranted.

Speaker Bio: Yolanda M. King is an Associate Professor of Law at the Northern Illinois University College of Law.  She teaches intellectual property related courses, including entertainment law.  Before joining the NIU faculty, Professor King practiced intellectual property law at Husch Blackwell Sanders Welsh & Katz and Brinks Hofer Gilson & Lione in Chicago, Illinois, where she engaged in domestic and international copyright and trademark prosecution, handled licensing issues, and represented clients in domain name matters.  In addition, she was an attorney in the City of Chicago Department of Law.
